Federal Judge Orders Halt to DACA Expansion

Mar 11, 2015 12:08:44 PM / by Staff Attorney

Within 48 hours of the launch date, U.S. District Judge Andrew Hanen of Texas put a stop to President Barack Obama’s expansion of the Deferred Action for Childhood Arrivals (DACA) program, which was expected to go into effect on February 18.

Under the proposed program, millions of undocumented immigrants who arrived in the United States before age 16 and living in the U.S. since January 1, 2010 would qualify for a three year deferred deportation action as well as work authorization.

However, not soon after the President announced his plan to make sweeping changes to the U.S. immigration system in November of last year, opposition steadily grew to block the Obama administration. Roughly two dozen states joined a lawsuit against the executive action. With Judge Hanan’s ruling on February 16, the DACA expansion and other immigration programs were put on hold.

Immigrant advocates and politicians across the nation have not been deterred by the injunction, however, viewing the situation as only a temporary road block. “The law is on our side and history is on our side,” said Obama as he and other supporters encouraged eligible immigrants to continue putting their applications together.
